Antolin Alcaraz is facing a three-match ban after the FA officially charged him with spitting at an opponent.
The FA have acted against the Wigan defender after referee Lee Probert confirmed in his match report that he did not see the incident, which happened during the Latics' 3-1 defeat at Wolves yesterday.
An FA spokesman said: "Antolin Alcaraz has today been charged by the FA with spitting at an opponent.
"He has until 6pm tomorrow to respond to the charge."
Wolves' Richard Stearman claims Alcaraz spat at him and the Paraguayan will miss Wigan's key games against Blackburn, Sunderland and Arsenal if he is found guilty.
Alcaraz's FA charge is the latest setback for Wigan, who are bottom of the Premier League, having lost their last eight league games.
